New Deadline For Transfer Petitions

Earlier this year, the Supreme Court of Indiana amended the Indiana Rules of Appellate Procedure to allow petitions to transfer to be filed up to 45 days after a decision is issued by the Court of Appeals.

The change takes effect January 1, 2019. My understanding is that the 45-day deadline will only apply to decisions handed down after January 1, 2019. If the Court of Appeals decided the case before January 1, 2019, the old 40-day deadline will still apply.

A copy of the rule change can be found here.
